In-flight internet service and American terms of use

Overview of internet service
American aircraft may offer access to internet service as well as other services, information and content. The services, information and content are made available subject to different terms and privacy policies based on who provides the services, information or content.
In-flight internet service is provided by one of the following third-party connectivity service providers, depending upon which flight you are on (it is not provided by American Airlines) and is subject to such third party’s terms of service / use and privacy policy, which you can view by clicking below (all such connectivity services are referred to as the “in-flight internet service”):

The above terms of service / use and privacy policies apply to both the free and paid in-flight internet service. THE INTERNET SERVICE PROVIDERS’ (INTELSAT’S, PANASONIC’S AND VIASAT’S) TERMS OF SERVICE / USE AND PRIVACY POLICIES APPLY AT THE POINT OF INTERNET ACCESS AND USE ON FLIGHTS SERVICED BY THAT PROVIDER. THE ABOVE TERMS ARE PROVIDED HERE FOR REFERENCE. YOUR ACCESS AND USE OF THE INTERNET SERVICE ON A FLIGHT CONFIRMS YOUR ACCEPTANCE OF THE APPLICABLE INTERNET SERVICE PROVIDER’S TERMS OF SERVICE/USE AND PRIVACY POLICY.
The American Airlines in-flight portal, through which you can access onboard live TV, wireless entertainment and other content and services, is subject to the American Airlines terms of use below and the American Airlines privacy policy. If you purchase or otherwise obtain a Wi-Fi subscription plan or single session pass for access to in-flight internet service, the information you provide American to purchase and register for the Wi-Fi plan or pass will be subject to the American Airlines terms of use below and the American Airlines privacy policy.
By using any of the services, information or content you agree to the applicable terms without limitation or qualification. Please read the applicable terms and privacy policies carefully, as they include important information about your legal rights. If you do not intend to be legally bound by the applicable terms, please do not access and use the service, information or content that is subject to those terms.
American Airlines Terms of Use
In these terms of use (“terms”), American Airlines, Inc. may be referred to as “American,” “we,” “our” or “us”; and “you” and “your” means you as the user. When we refer to the “Content and Interfaces,” we mean any user interface, application, website, content, information and / or services that American provides to you, including without limitation the portal for purchasing and registering for subscription plans and single-session passes for in-flight internet service, the portal home page provided by American that provides you with the ability to access certain content and media in-flight like onboard live TV, and the third-party material (as defined below) that American provides to you through such home page or through the other user interfaces and / or services provided by American. For the avoidance of doubt, the Content and Interfaces do not include the in-flight internet services.
Except as set forth in our terms of sale for in-flight internet service, American may change these terms or the Content and Interfaces at any time without notice or liability. By using the Content and Interfaces after we change these terms, you agree to any changes on a going-forward basis, so you should review these terms whenever you use the Content and Interfaces. American also reserves the right in its sole and unfettered discretion to suspend or otherwise deny you access to the Content and Interfaces at any time.
By using the Content and Interfaces, you represent and warrant that you possess the legal right and ability to agree to these terms and to use the Content and Interfaces in accordance with all of these terms.
PLEASE NOTE THAT THE SECTION ON “FORUMS OF ACTIONS, GOVERNING LAW AND PROCEDURAL RESTRICTIONS” CONTAINS A CLASS ACTION WAIVER. BY AGREEING TO THE TERMS, YOU AGREE THAT YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS OR REPRESENTATIVE ACTIONS.
Access to Content and Interfaces
You represent and warrant that you will provide accurate, current, complete and updated information, including payment and other registration information, when accessing or using the Content and Interfaces, including without limitation for any in-flight internet service purchase, and that you have the legal right and ability to provide and otherwise use such information and the payment methods which you provide to us or our payment processor.
To use or access the in-flight internet service or certain portions of the Content and Interfaces, you may be able to or may be required to input your AAdvantage® account credentials or create an AAdvantage® account (the “Account”). You are solely responsible (financially and otherwise) for all use of the Content and Interfaces and the in-flight internet service under your name or Account and for maintaining the confidentiality and security of your password for your Account. You must take precautions to ensure the security of your Account password. You must immediately notify AAdvantage® customer service in the event you believe your Account or password may have been compromised or misused. AMERICAN IS NOT LIABLE FOR ANY ACTS OR OMISSIONS BY YOU IN CONNECTION WITH YOUR ACCOUNT. FURTHERMORE, AMERICAN ASSUMES NO RESPONSIBILITY FOR AND WILL NOT BE LIABLE IN THE EVENT THAT ANOTHER PERSON LEARNS YOUR PASSWORD OR USES YOUR PASSWORD TO CAUSE DAMAGE TO YOU. WHILE AMERICAN TAKES REASONABLE STEPS TO SAFEGUARD AND TO PREVENT UNAUTHORIZED ACCESS TO YOUR PERSONAL INFORMATION, WE CANNOT BE RESPONSIBLE FOR THE ACTS OF THOSE WHO GAIN UNAUTHORIZED ACCESS, AND WE MAKE NO WARRANTY, EXPRESS, IMPLIED OR OTHERWISE, THAT WE WILL PREVENT UNAUTHORIZED ACCESS TO YOUR PERSONAL INFORMATION.
AAdvantage® customer service
When you make purchases (other than purchases with AAdvantage® miles), you (a) agree to pay the price set forth for such purchases, and all applicable taxes in connection with your purchase (the “full purchase amount”), and (b) authorize us or our payment processor to charge your credit card or other payment method for the full purchase amount. You acknowledge and agree that we may charge your credit card or other payment method for the full purchase amount on the date of purchase, rather than on the ultimate date of use. Unless otherwise noted, all currency references are in U.S. dollars. All fees and charges are payable in accordance with payment terms in effect at the time the fee or the charge becomes payable.
We may offer certain promotional codes, referral codes or similar promotional coupons (“promotional codes”) that may be redeemed for discounted or free future products or services, or other features or benefits related to the Content and Interfaces, subject to any additional terms that American establishes. You agree that promotional codes: (a) must be used in a lawful manner; (b) must be used for the intended audience and purpose; (c) may not be duplicated, sold or transferred in any manner, or made available to the general public (whether posted to a public forum, coupon collecting service or otherwise), unless expressly permitted by American; (d) may be disabled or have additional conditions applied to them by American at any time for any reason without liability to American; (e) may only be used pursuant to the specific terms that American establishes for such promotional code; (f) are not valid for cash or any credits or points offered via any Content and Interfaces; and (g) may expire prior to your use.
Location of our privacy policy and other applicable policies
Consistent with the American privacy policy, we may ask you to provide and / or we may otherwise collect certain information when you use the Content and Interfaces. Our privacy policy describes how we handle the information you provide to us when you use the Content and Interfaces. Please visit our privacy policy. You consent to all actions we may take with respect to your information that are consistent with our privacy policy.
Your use rights; limitations on those rights
We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable license to access and use, on your personal computer or other personal device, the Content and Interfaces, solely for your personal, non-commercial purposes in accordance with the ordinary and intended function of the Content and Interfaces and with these terms, and for no other purposes. This license is revocable at any time in our sole discretion.
Except as necessary to purchase, register for or log-in to the in-flight internet service or as otherwise authorized by American, you may not give access to your Account or Account information to any third party or access your Account or Account information through a third party, including, but not limited to any mileage management service, mileage tracking service or mileage aggregation service. Unless otherwise authorized by American, you must access your Account information directly through the Content & Interfaces or via the in-flight internet connectivity service provider’s purchase pages. You also violate these terms if you enable another AAdvantage® member to access your Account information other than through the foregoing authorized channels.
You agree that you will not misuse the Content and Interfaces. American prohibits all misuse of the Content and Interfaces. With respect to the Content and Interfaces, “misuse” means to misuse the Content and Interfaces and includes, but is not limited to, using the Content and Interfaces to do (or otherwise doing in connection with the Content and Interfaces) any of the following:
- Disrupt any aspect of our operations;
- Distribute, disseminate, post or publish any information or material that degrades, embarrasses, harasses, humiliates, intimidates or threatens any individual or group of individuals on the basis of their age, ancestry, color, ethnicity, marital status, medical condition, mental or physical disability, national origin, race, sex, sexual orientation, union or non-union affiliation or any other basis protected by federal, state or local law or ordinance;
- Abuse, defame, harass, stalk, threaten or otherwise violate others’ legal rights, including but not limited to rights of privacy and publicity;
- Download or upload files that may damage the operation of our or another’s computer(s), such as computer viruses, corrupt files or similar software;
- Violate the rights of others, including without limitation intellectual property, privacy or publicity rights;
- Misrepresent, mislead or omit the origin or source of any material or use a false email address or other identifying information, impersonate or misrepresent any person or entity or your affiliate with any person or entity;
- Download or upload materials that do not contain the applicable proprietary language, author attributions and / or copyright, patent or trademark notices;
- Distribute, disseminate, post or publish any indecent, infringing, obscene or unlawful information or material;
- Engage in any commercial purpose including but not limited to: Advertising or offering to sell any goods or services; conducting contests or surveys; distributing chain letters, or advertising with respect to any Ponzi scheme or pyramid scheme; and advertising or offering to sell any business opportunities, direct sales opportunities, employment, independent contractor positions, multi-level marketing opportunities or securities
- Post, send or otherwise disclose confidential information, trade secrets or other confidential or protected proprietary data of any entity or person, including but not limited to American Airlines, Inc. or its subsidiaries and affiliates;
- Copy or create derivative works from, publicly display, distribute, license, publicly perform, publish, recreate, reproduce, sell, transfer or transmit any information, products, services or software obtained by, from or through the Content and Interfaces except to the extent that such activities are a part of the ordinary and intended use of the Content and Interfaces;
- Monitor or copy any service, product, data or content by using any manual process, or any robot, spider or other automatic device, without first obtaining our prior written consent;
- Take any action that will or could impose an unreasonable or disproportionately large load on our information technology infrastructure;
- Engage in activities to discover or identify aspects of the infrastructure of the Content and Interfaces for the purpose of gaining unauthorized access or information;
- Act as a mileage management service, mileage tracking service or mileage aggregation service for any AAdvantage® member;
- Access information about any AAdvantage® member protected by a login requirement;
- Post any information about another AAdvantage® member on any other website without that AAdvantage® member’s consent;
- Utilize another AAdvantage® member’s account, user ID, password, account information, personal identification numbers (“PINs”) or other login information;
- Make unauthorized changes to another person’s account or itineraries;
- Engage in any act or omission that may subject American or any other person to legal liability; or
- Engage in any other conduct that is, or that American deems to be, in conflict with these terms.
Intellectual property rights
Unless otherwise noted, all aspects of the Content and Interfaces, including all information, articles, audio, data, images, pictures, text, video, content, information, links, passwords, PINs, screens, user names or other content or materials, including their “look and feel,” appearing on the Content and Interfaces and the account information, are the exclusive property of American and / or its affiliates and / or its licensors and are protected under copyright, trademark and other intellectual property laws. You agree that American and / or its affiliates and / or its licensors own(s) all right, title and interest in and to the Content and Interfaces (including any and all intellectual property rights therein) and you agree not to take any action(s) inconsistent with such ownership interests. Except as expressly set forth in these terms, nothing on the Content and Interfaces shall be construed to confer any grant or license of any intellectual property rights, whether by estoppel, by implication or otherwise. We, our affiliates and our licensors reserve all rights in connection with the Content and Interfaces and account information, including, without limitation, the exclusive right to create derivative works. The trademarks, logos, service marks and trade dress (collectively the “trademarks”) displayed on the Content and Interfaces are registered and unregistered trademarks of American, or others who may or may not be affiliated with us. You may not use, reproduce or remove any trademarks, service marks, other source identifiers or proprietary notations displayed on or through the Content and Interfaces without our prior written consent.
Notice of infringement – DMCA policy
If you believe that any text, graphics, photos, audio, videos or other materials or works uploaded, downloaded or appearing on or as part of the Content and Interfaces have been copied in a way that constitutes copyright infringement, you may submit a notification to our copyright agent in accordance with 17 USC 512(c) of the Digital Millennium Copyright Act (the “DMCA”), by providing the following information in writing:
- Identification of the copyrighted work that is claimed to be infringed
- Identification of the allegedly infringing material that is requested to be removed, including a description of where it is located on the Content and Interfaces
- Information for our copyright agent to contact you, such as an address, telephone number and e-mail address;
- A statement that you have a good faith belief that the identified, allegedly infringing use is not authorized by the copyright owners, its agent or the law;
- A statement that the information above is accurate, and under penalty of perjury, that you are the copyright owner or the authorized person to act on behalf of the copyright owner; and
- The physical or electronic signature of a person authorized to act on behalf of the owner of the copyright or of an exclusive right that is allegedly infringed

It is our policy, in appropriate circumstances and at our discretion, to disable or terminate the accounts of users who repeatedly infringe copyrights or intellectual property rights of others.
A user of the Content and Interfaces who has uploaded or posted materials identified as infringing as described above may supply a counter-notification pursuant to sections 512(g)(2) and (3) of the DMCA. When we receive a counter-notification, we may reinstate the posts or material in question, in our sole discretion. To file a counter-notification with us, you must provide a written communication (by fax or regular mail or by email) that sets forth all of the items required by sections 512(g)(2) and (3) of the DMCA. Please note that you will be liable for damages if you materially misrepresent that content or an activity is not infringing the copyrights of others.
Third-party materials
The Content and Interfaces may display, include or make available audio, data, images, pictures, text, video, content, services, websites, applications or other information or materials, in each case from third parties (“third-party materials”) or provide links to certain third-party materials. The in-flight internet service may also make available or link to third-party materials.
You acknowledge and agree that we are not responsible for examining or evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of the third-party materials that you access or the in-flight internet service. We do not warrant or endorse, and do not assume and will not have any liability or responsibility to you or any other person for, any third-party materials that you may elect to view or download or your use of the in-flight internet service. Third-party materials, links or pointers to third-party materials and access to the in-flight internet service are provided solely as a convenience to you. You assume sole responsibility for use of third-party materials and links or pointers to third-party materials and for your access to and use of the in-flight internet service and anything you access via the in-flight internet service. You are responsible for all consents, royalties and fees related to third-party vendors whose sites, products or services you access, buy or use.
As noted above, American is not responsible for providing the in-flight internet service. You access and use the in-flight internet service at your own risk, and you understand that your ability to access the in-flight internet service and its quality may vary based on a number of factors, like the number of other persons on your flight who are using the internet and other possible disruptions to the satellite connection.
You acknowledge and agree that your access to the internet via the in-flight internet service may not be secure or stable, and you agree to take all precautions for the security of your device and information when using the in-flight internet service. You agree not to link or tether any equipment or device connected to Internet via the in-flight internet service with any other device or equipment. You acknowledge and agree that American is not liable for any interruption in Internet connectivity via the in-flight internet service, for any data you may lose or that may become corrupted or misdirected because of interruptions or performance issues with the in-flight internet service, for any data that may be intercepted while you use the in-flight internet service or for any viruses or other malicious software transmitted to your equipment or device when using the in-flight internet service.
Although American is not the provider of the in-flight internet service, American reserves the right to limit or throttle the amount of data or content that can be accessed via the in-flight internet service, including without limitation to ensure stability and bandwidth for other users and American reserves the right to, immediately and without notice, suspend your access to the in-flight internet service if American suspects that you are abusing the in-flight internet service (as determined in the sole discretion of American), such as by transmitting a virus (or any other manipulating program capable of modifying other programs and replicating itself) or circumventing any restrictions placed on your access or use of the in-flight internet service.
Your indemnity obligations
You agree to indemnify and hold American and each of the American entities (as defined below) harmless from and against any and all liabilities, losses, damages, costs and expenses (including without limitation attorneys’ fees and costs) (collectively, “losses or other liabilities”), based on, arising out of or resulting from your use of the Content and Interfaces, third-party material, and / or the in-flight internet service, including without limitation any losses or other liabilities arising out of or resulting from claims, demands, suits, actions or other proceedings alleging facts that if true would constitute your breach of these terms but except to the extent that the losses or other liabilities are caused by American’s negligence or willful misconduct. American may participate in the defense or settlement of any claim, demand, action or other proceeding as determined in its sole discretion.

The Content and Interfaces and third-party materials may contain inaccuracies and / or typographical errors. American makes no commitment to update the Content and Interfaces or third-party materials. American makes no representations about any of the Content and Interfaces’, in-flight internet service or third-party materials’ suitability for any purpose.
Because American provides services and products in many parts of the world, the Content and Interfaces may refer to certain goods, products and / or services that are not available in your area. A reference to goods, products and / or services without limiting their geographic scope does not imply that American offers or intends to offer those goods, products and / or services in all locations.
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, YOUR ACCESS TO AND USE OF THE CONTENT AND INTERFACES, THE IN-FLIGHT INTERNET SERVICE AND / OR THE THIRD-PARTY MATERIALS ARE AT YOUR OWN RISK. THE CONTENT AND INTERFACES AND ACCESS TO THE IN-FLIGHT INTERNET SERVICE AND ANY THIRD-PARTY MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT ANY REPRESENTATION OR WARRANTY OF ANY KIND BY OR FROM THE AMERICAN ENTITIES (AS DEFINED BELOW). WITHOUT LIMITING THE FOREGOING, AMERICAN, ITS PARENT, SUBSIDIARIES, AFFILIATES, RELATED COMPANIES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, PARTNERS AND LICENSORS (INCLUDING AMERICAN, THE “AMERICAN ENTITIES”) DISCLAIM ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND WITH RESPECT TO THE CONTENT AND INTERFACES, THE IN-FLIGHT INTERNET SERVICE AND / OR ANY THIRD-PARTY MATERIALS THAT YOU ACCESS OR USE THROUGH THE CONTENT AND INTERFACES AND / OR THE IN-FLIGHT INTERNET SERVICE, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF EXPECTATION OF PRIVACY, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, NON-INFRINGEMENT OR TITLE. FURTHER, AMERICAN DOES NOT WARRANT OR REPRESENT THAT YOUR USE OF THE CONTENT AND INTERFACES, THE IN-FLIGHT INTERNET SERVICE AND / OR THE THIRD-PARTY MATERIAL WILL NOT INFRINGE THIRD PARTY INTELLECTUAL PROPERTY RIGHTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMERICAN DOES NOT MAKE ANY REPRESENTATIONS, WARRANTIES OR OTHER GUARANTEES ABOUT THE SECURITY, STABILITY, AVAILABILITY, QUALITY, TIMELINESS, COMPLETENESS, ACCURACY OR OTHER ASPECTS OF THE IN-FLIGHT INTERNET SERVICE, CONTENT & INTERFACES, OR ANY THIRD-PARTY MATERIAL AVAILABLE ON OR THROUGH THE CONTENT AND INTERFACES OR THE IN-FLIGHT INTERNET SERVICE.
Some jurisdictions do not allow the exclusion of or limitation of implied warranties or consequential or incidental damages, so portions of the above exclusions may not apply to you.
Limitation of liability
TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT IN NO EVENT WILL ANY OF THE AMERICAN ENTITIES BE LIABLE TO YOU OR TO ANY PERSON CLAIMING BY, THROUGH OR UNDER YOU FOR ANY LOST PROFITS OR EQUIPMENT DOWN TIME OR FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL OR EXEMPLARY DAMAGES OF ANY KIND, HOWSOEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, WHETHER UNDER THESE TERMS OR OTHERWISE ARISING IN ANY WAY IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE CONTENT AND INTERFACES OR THE IN-FLIGHT INTERNET SERVICE OR THIRD-PARTY MATERIALS, REGARDLESS OF WHETHER ANY OF THE AMERICAN ENTITIES WERE GIVEN ACTUAL OR CONSTRUCTIVE NOTICE THAT ANY SUCH DAMAGES WERE POSSIBLE. THE AMERICAN ENTITIES’ TOTAL LIABILITY TO YOU FOR ANY AND ALL DAMAGES UNDER THESE TERMS OR OTHERWISE ARISING IN ANY WAY IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE CONTENT AND INTERFACES OR THE IN-FLIGHT INTERNET SERVICE OR THE THIRD-PARTY MATERIALS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00) IN THE AGGREGATE. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF YOUR REMEDY AS SO LIMITED FAILS OF ITS ESSENTIAL PURPOSE.
IN NO EVENT SHALL ANY OF THE AMERICAN ENTITIES BE LIABLE FOR ANY DAMAGES (WHETHER ACTUAL, DIRECT, CONSEQUENTIAL, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR OTHERWISE) ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, A THIRD PARTY'S UNAUTHORIZED ACCESS TO YOUR PERSONAL INFORMATION PROVIDED IN CONNECTION WITH THE CONTENT AND INTERFACES OR IN-FLIGHT INTERNET SERVICE OR THE THIRD-PARTY MATERIALS, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, STRICT LIABILITY, TORT OR OTHER THEORIES OF LIABILITY, AND ALSO REGARDLESS OF WHETHER ANY OF THE AMERICAN ENTITIES WAS GIVEN ACTUAL OR CONSTRUCTIVE NOTICE THAT DAMAGES WERE POSSIBLE.
Some jurisdictions do not allow the exclusion or limitation of damages, so portions of the foregoing limitations may not apply to you.

American will not treat as confidential any communications you send to us by electronic mail or otherwise and will have no obligation to refrain from publishing, reproducing or otherwise using such communications in any way or for any purpose, except as may be required by applicable law.
The Content and Interfaces may provide you with information as to how you can contact American or certain of its service providers by telephone. You may use these functions only for purposes of obtaining assistance or communicating with American or its service providers regarding your personal use of the Content and Interfaces. For quality assurance purposes, American or its service providers may monitor, record and / or transcribe the contents of these communications. By contacting American or its applicable service provider, you agree that the communication may be monitored, recorded and / or transcribed and you consent to the monitoring, recording and / or transcribing. Such records may, to the extent permitted by applicable law, be kept indefinitely or disposed of at our discretion.
We welcome feedback, comments and suggestions for improvements to the Content and Interfaces (“feedback”). You acknowledge and expressly agree that any contribution of feedback does not and will not give or grant you any right, title or interest in the Content and Interfaces or in any such feedback. All feedback becomes the sole and exclusive property of American and we may use and disclose feedback in any manner and for any purpose whatsoever without further notice or compensation to you and without retention by you of any proprietary or other right or claim. Except as prohibited by law, you hereby assign to American any and all right, title and interest (including, but not limited to, any patent, copyright, trade secret, trademark, show-how, know-how, moral rights and any and all other intellectual property rights) that you may have in and to any and all feedback. To the extent that the foregoing assignment is prohibited by law, you hereby grant to American a non-exclusive, sublicensable (through multiple levels), transferrable, royalty-free, fully paid up, worldwide right and license to exploit any and all rights that you may have in and to such feedback.
American does not accept or consider unsolicited proposals related to its business, including but not limited to proposals for advertising campaigns, logos, names, processes, products, promotions, services, slogans and technologies. American therefore requests that you not send such proposals. Please also refrain from sending original creative artwork, blueprints, demonstratives, designs, layouts, photographs or samples. American has adopted this policy to prevent claims that we have copied such unsolicited ideas without authorization, when, in fact, we developed the idea independent of or even long before receiving the unsolicited proposal. If you do send us unsolicited proposals, then do so with the understanding that American may use any concepts, ideas, inventions, know-how or techniques that you disclose in those communications for any purpose, including the developing, manufacturing and / or marketing of goods, products or services. American may do so free of any obligation to compensate you for that use.
Your use of forums
You agree to use any chat rooms or other communication or message facilities (“forums”) contained on the Content and Interfaces only to send and receive material and messages that are proper and related to the particular forum. You further agree that you will use the forums in conformity with all applicable laws and these terms. You agree that you will not misuse a forum.
American reserves the right to remove at will and without notice any content on the Content and Interfaces, including anything you post in a forum. You understand that any use by you of a forum constitutes a public communication. Except as prohibited by law, you understand that American owns any and all information or material that you post on a forum, and you agree that you waive all of the rights you have in or to any information or material that you post on a forum. Except as prohibited by law, American has the right to do whatever it wishes with that information or material, including but not limited to deleting or editing for any reason any posting by you. You further acknowledge that American does not endorse or sponsor any information or material posted by forum users and that American has no responsibility to approve, review or screen such information or material.
Forum of actions, governing law and procedural restrictions
You agree that the agreement set forth in these terms is made and entered into in Tarrant County, Texas. You agree that Texas law governs the interpretation of these terms and any dispute arising from your access to, dealings with or use of the Content and Interfaces, without regard to conflicts of law principles. Except as may otherwise be expressly provided in the conditions of carriage for claims related to that agreement, any dispute, claim or controversy between you and American related to these terms must be brought in the state or federal courts of Tarrant County, Texas. YOU AGREE THAT ANY DISPUTE, CLAIM OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION OR VALIDITY THEREOF WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A NAMED-PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. YOU AND AMERICAN EACH WAIVE ANY RIGHT TO A TRIAL BY JURY.
Access to the in-flight internet service and receipt of push messages
You are responsible for providing the device, software and / or other equipment or services that you need to access and use the in-flight internet service. For the avoidance of doubt, if you use in-flight internet service from our third-party connectivity service provider, we do not guarantee that the in-flight internet service can be accessed and used on any particular device. We do not guarantee that the in-flight internet service or the Content and Interfaces will be available, or that orders for travel can be placed, in or from any particular geographic location or at any particular time. You may receive push notifications, local client notifications, text messages, picture messages, alerts, emails or other types of messages directly sent to you (“push messages”). You acknowledge that your service provider may charge you fees for data, text messaging and / or other wireless access including in connection with push messages. You have control over the push messages settings and can opt in or out of these push messages through your device’s operating system (with the possible exception of infrequent, important service announcements and administrative messages). Please check with your service provider to determine what fees (if any) from such provider apply to your access to and use of the in-flight internet service or your receipt of push messages. You are solely responsible for any fee, cost or expense that you incur to access and / or use the in-flight internet service on your device or for your receipt of push messages.

Miscellaneous
These terms (and, if you purchase or obtain a subscription plan or single session pass for in-flight internet service, the terms of sale) constitute the entire agreement between you and American governing your access to, dealings with and use of the Content and Interfaces. Separate terms and privacy policies (including without limitation our conditions of carriage, which applies to any purchase of airfare and / or flights operated by American) may attach to any services, information or content you obtain, purchase or use from the Content and Interfaces or any accounts. In the case of a conflict between these terms and any other terms between you and American that are specific to any services, information or content that you obtain, purchase or use from the Content and Interfaces or to any accounts, the specific terms shall govern solely as to such services, information, content or accounts. Your purchase of any ticket for travel on American and any travel on American are subject to the terms and conditions contained in your ticket, our conditions of carriage and our published fare rules and regulations. In order of precedence, our conditions of carriage will prevail over these terms solely in regard to the purchase of tickets and any travel on American.
You agree not to assign, transfer or sublicense your rights pursuant to these terms without our express prior written consent. Any purported assignment, transfer or sublicense not in compliance with these terms shall be void and of no effect. American may assign, transfer or sublicense its rights pursuant to these terms without your consent. Any failure of American to assert any right it may have under these terms does not constitute a waiver of our right to assert the same or any other right at any other time or against any other person or entity. If any provision of these terms shall be unlawful, void or unenforceable for any reason, then that provision shall be deemed severable from these terms and shall not affect the legality, validity or enforceability of any remaining provisions.
